X Competition Terms & Conditions

1. ELIGIBILITY

This promotion is open to all individuals aged 18 or over who are a registered member of the website www.twitter.com (the "Website").

Employees of Utilita Energy Ltd ("the Promoter") are not eligible, nor are members of these employees' families (defined as parents, children, siblings, spouse and life partners) and anyone else professionally connected with this promotion.

2. ENTRY

To be entered into the promotion you must:

Once you have complied with the competition post in accordance with these terms and conditions, you will be entered into a prize draw for a chance to win the stated prize (a pair of New Balance running trainers).

Entries will be ineligible for the prize draw if they:

  • Are incomplete;
  • Are considered by the Promoter to contain inappropriate content;
  • Exceed the maximum number of entries allowed per person;
  • Are received outside of the Promotion Period set out below;
  • Are considered indecent or offensive.

Only one (1) entry per person will be accepted in the competition (one through X). No purchase necessary to enter the promotion. Entry constitutes full and unconditional acceptance of these terms and conditions. The Promoter is not responsible for lost, corrupted or delayed entries. The Promoter reserves the right to disqualify anyone who violates these terms and conditions.

3. TIMING

This promotion runs from 2pm on Tuesday 11th September 2018 until 2pm on Friday 21st September 2018 (the “Promotion Period”).

4. SELECTION OF WINNER

All valid entries will be submitted for the prize draw. There will be 1 winner via X. The winner will be selected at random out of the valid entries.

The winning entry will be determined by a random draw conducted by the promoter on Friday 21st September 2018.

The winner will be notified through the social media platform they entered through (X) on Friday 21st September 2018. The winner must respond to such notification and provide the details requested. If a potential winner does not confirm receipt of the notification by Friday 28th September, an alternative winner will be selected on the same basis as described above in section 4. The winner may be asked to provide identification proving their eligibility before they are entitled to receive the prize.

5. THE PRIZE

There is a total of 1 prize via the social media platform (X) for the selected winner.

The winner will be sent the prize via postal service (whichever preferred by the winner). The prize will be sent by the promoter no later than 28 days after the winner has responded to the notification in section 4 above.

The Promoter is not responsible where incorrect contact details are provided.

The Promoter will not offer any alternative prizes for this competition.

The Promoter will only offer the prize in standard shoe sizes, and is not liable for any subsequent use of the prize.

6. OTHER

No correspondence will be entered into regarding either this promotion or these terms and conditions. In the unlikely event of a dispute, the Promoter’s decision shall be final. The Promoter reserves the right to amend, modify, cancel or withdraw this promotion at any time but only before the delivery of prize, without notice.

If any provision or part of these terms and conditions is deemed void or otherwise unenforceable in law then that provision or part shall be deemed excluded and the remainder of these terms and conditions shall remain in force.

These terms and conditions, the conduct of this promotion and the interpretation and enforcement of these terms and conditions shall be exclusively governed and construed in accordance with the laws of England and Wales. Entrants irrevocably submit to the exclusive jurisdiction of the Courts of England and Wales.

This promotion is not sponsored, endorsed or administered by X. You are providing your information to the Promoter and not to X. By entering, entrants agree to release X from all liability, injuries, loss and/or damage of any kind arising from their participation in the promotion and/or the acceptance and/or use/misuse of the prize.

7. SPIRIT OF THE PROMOTION

If an entrant attempts to compromise the integrity or the legitimate operation of this promotion by hacking or by cheating or committing fraud in ANY way, we may seek damages from that entrant to the fullest extent permitted by law. Further, we will disqualify that entrant’s entry to this promotion and may ban the entrant from participating in any of our future promotions.

Utilita Energy Limited is the controller in respect of personal information used in connection with this competition. WHAT INFORMATION WE MAY COLLECT AND HOW WE USE IT

We collect information supplied to us by yourself when entering the competition.

This includes but is not limited to:

  • Social network information contained on either your X account
  • Your image provided to us as part of your competition entry.

We process this information with your consent. This consent is gained by yourself entering the competition on X or Facebook via the competition entry instructions.

Utilita will only process this personal data for the purposes of selecting a winner of our competition and will dispose of the collected personal data after it is finished, and the prizes have been claimed.

Your Rights

You have in connection with this competition the below rights:

  • The right to object
  • The right of access
  • The right of erasure
  • The right to restrict processing

If one of the above rights are exercised you will be excluded from the competition, as we will be unable to process the data required to complete your entry.

Changes to this notice

Any changes that we may make to this Privacy Information Notice will be posted online or included in communications to you from time to time.
